Buyer: The person or organization that provides name, surname, address, email and phone details on the order form ("Buyer"). The details on the order form are an integral part of this agreement.
If the Buyer is a consumer, the Consumer Protection Law No. 6502 ("TKHK") and the Distance Contracts Regulation ("Regulation") apply; if the Buyer is a merchant or an organization, the Turkish Commercial Code and the Turkish Code of Obligations apply (see section 10).
Subject of the agreement
The subject of this agreement is to set out the rights and obligations of the parties under the TKHK and the Regulation regarding the sale and delivery of the product described below, which the Buyer ordered electronically from the Seller's website at hexacam.pages.dev.
Product, price and payment details
- Product: Hexa sports camera — a dual-lens, portable, tripod-mounted AI sports camera. Box contents: device, charger, carry case. The mobile app and the auto-framing and stitching software are included with the device.
- Unit price: 60,000 TL. VAT is included in the price.
- Quantity: as selected on the order form (at most 10 per order).
- Shipping fee: [SHIPPING FEE].
- Payment method: bank transfer (havale / EFT).
- Delivery address, invoice address and invoice type: as declared on the order form.
The sale is one-time; there is no subscription, monthly fee or mandatory add-on service. The price is the price on the order date; a later change of the price on the website does not affect an order already placed. The order number, date, quantity and total amount appear in the order confirmation email sent to the Buyer and form an integral part of the agreement.
Pre-contractual information and formation of the agreement
The Buyer accepts that, before submitting the order, they were informed about the main characteristics of the product, the sale price, payment and delivery details, the right of withdrawal, the Seller's identity and contact details and the complaint channels through the product, buy and returns pages on the website and this agreement, and that they confirmed this information electronically (Regulation Arts. 5-7).
The agreement is formed when the Buyer ticks the consent boxes on the order form and submits the order, and the Seller sends the confirmation email containing the order number. The confirmation email contains a permanent link to this agreement; the Buyer may save and print the text.
Payment
Payment is made by bank transfer (havale / EFT). After the order confirmation, the Seller sends the bank account details (IBAN) to the Buyer in a separate email. The Buyer transfers the total amount in a single payment, writing the order number in the description field. Interbank transfer fees are borne by the Buyer.
Until the payment reaches the Seller's account, the order is a pre-order. If payment is not made within [PAYMENT PERIOD] days of the IBAN email being sent, the Seller may cancel the order; the Buyer may place a new order if they wish. The Seller's delivery obligation does not arise before payment is received.
Delivery
After payment reaches the Seller's account, the product is shipped by [COURIER COMPANY] to the delivery address on the order form, within Turkey. Delivery outside Turkey is not covered by this agreement. The target dispatch time is [DISPATCH TIME] business days; in any case the delivery period may not exceed 30 days from receipt of payment (Regulation Art. 16). If delivery cannot be made within this period, the Buyer may terminate the agreement; the amount paid is refunded within 14 days.
The tracking number is sent to the Buyer's email address. The Buyer checks the package on delivery; crushed, torn or opened packages should be refused with a damage report drawn up by the courier. Transport damage noticed after delivery must be reported to [EMAIL] with photos within 3 days at the latest.
If the product cannot be delivered because the Buyer is absent at the address or the address is wrong, the cost of re-shipping is borne by the Buyer. Delivery may be delayed in the event of force majeure (natural disaster, epidemic, disruption of transport infrastructure etc.); the Seller informs the Buyer.
Right of withdrawal
If the Buyer is a consumer, they may withdraw from the agreement within 14 days of receiving the product, without giving any reason and without paying any penalty (TKHK Art. 48, Regulation Art. 9). The right of withdrawal may also be exercised between formation of the agreement and delivery.
The withdrawal notice is sent before the period ends by email to [EMAIL], stating the order number and clearly expressing the intention to withdraw; the Seller confirms receipt by email. The burden of proving that the right of withdrawal was exercised lies with the Buyer.
Within 10 days of the withdrawal notice, the Buyer sends the product, with its box, accessories and invoice if any, to the return address notified by the Seller ([SERVICE / RETURN ADDRESS]). For returns sent with the courier designated by the Seller, the shipping cost is borne by the Seller; if the Buyer chooses another carrier, the Buyer pays the shipping cost.
The Seller refunds the product price and any delivery costs by bank transfer to the account the payment was made from, within 14 days of receiving the withdrawal notice.
During the withdrawal period the Buyer may use the product only for inspection, in line with its operation, technical specifications and instructions. The Buyer is liable for any loss of value caused by use beyond this (scratches, breakage, missing accessories, liquid damage etc.); this amount is deducted from the refund (Regulation Art. 13).
Cases where the right of withdrawal cannot be used
Under Article 15 of the Regulation, the right of withdrawal cannot be exercised for: goods made to the Buyer's specifications or personalized; perishable goods; goods unsuitable for return for health or hygiene reasons once unsealed; goods that become mixed with other items after delivery; digital content, audio and video recordings and software whose packaging has been opened; services performed instantly in an electronic environment; services whose performance began with the Buyer's approval before the withdrawal period ended.
The Hexa camera is a standard, mass-produced product; it does not fall under the personalized-goods exception. Opening the box or packaging does not on its own remove the right of withdrawal. The device software comes with the device and is not a separately sold software license.
Warranty and defective goods
The product carries a 2-year warranty from the delivery date (TKHK Art. 56, Warranty Certificate Regulation). The warranty certificate is delivered with the product and by email. The warranty covers faults arising from material, workmanship and assembly defects. Repair time may not exceed 20 business days; time spent in repair is added to the warranty period.
If the Buyer is a consumer, for a defect that appears within 2 years of delivery they may choose one of the following under TKHK Art. 11: rescission of the agreement, a price reduction, free repair, or replacement with a defect-free equivalent. Defects that appear within 6 months of delivery are presumed to have existed at the time of delivery.
Drops and impacts, liquid ingress, unauthorized intervention, use of an unsuitable charger and natural wear (including the gradual reduction of battery capacity) are outside the warranty. Out-of-warranty repairs are carried out after a quote and with the Buyer's approval.
Service and return address: [SERVICE / RETURN ADDRESS]. Warranty claims are made to [EMAIL] with the order number and a description of the fault.
Non-consumer buyers
Purchases made on behalf of sports clubs, companies, associations, municipalities and other organizations, or for professional / commercial purposes, are outside the scope of the TKHK; the Turkish Commercial Code and the Turkish Code of Obligations apply to them. For merchant buyers, the notification periods in Art. 23 of the Turkish Commercial Code apply to defects (2 days for apparent defects, 8 days for others).
The Seller contractually extends the 14-day return option in section 7 and the 2-year warranty in section 9 to non-consumer buyers under this agreement on the same terms.
Resolution of disputes
Consumer buyers may apply to the Consumer Arbitration Committee at their place of residence or at the Seller's location, within the monetary limits set each year by the Ministry of Trade, and to the Consumer Court for disputes above the limit. For disputes with non-consumer buyers, the courts and enforcement offices of [CITY] have jurisdiction.
We prefer to resolve problems together first: write to [EMAIL] with your order number; requests are answered as soon as possible.
General provisions and entry into force
By ticking the consent box on the order form, the Buyer declares that they have read and accept all sections of this agreement. The agreement enters into force on the date the order confirmation email is sent.
The Seller keeps records relating to the right of withdrawal, information, delivery and other obligations for 3 years under Art. 20 of the Regulation. The Buyer's personal data is processed as described in the Data Protection Notice (KVKK).
This agreement is governed by Turkish law. In case of any difference between the Turkish and English texts of the agreement, the Turkish text prevails.
